Legislative Decree · 1977-06-30 · 140 articles

The President of the Republic, pursuant to the Constitution, pursuant to Law No. 2/76 dated 30 December 1976 (granting the Government the right to issue legislative decrees), and after consulting the Council of State, upon the proposal of the Minister of Interior, and with the approval of the Council of Ministers dated 27 June 1977, hereby decrees the following:

Section 1

Municipalities — Definition — Establishment

ARTICLE 1

Definition of a Municipality

A municipality is a local administration that, within its territorial jurisdiction, exercises the powers vested in it by law. A municipality shall have legal personality and financial and administrative independence within the limits prescribed by law.

ARTICLE 2

Establishment of a Municipality

A municipality shall be established in every city, or in every village or group of villages whose names appear in Table No. 1 annexed to Legislative Decree No. 11 dated 29 December 1954 and its amendments, in accordance with the provisions of this Law.

ARTICLE 3

Article 3 was repealed by Article 45 of Law No. 665 dated 29/12/1997.

3. Text of Article 3 before its repeal: A municipality shall be established in populated places where the number of residents registered in the civil status records exceeds one thousand five hundred persons, provided that the estimated annual financial revenues exceed ten thousand Lebanese pounds.

4. Text of Article 4 before its repeal: Existing municipalities and neighbouring villages united by geographical, economic and urban factors may be merged and treated as a single municipality if the estimated annual financial revenues of each do not exceed ten thousand pounds. Merger shall be effected by decree upon the proposal of the Minister of Interior, specifying the villages comprising the municipality, its name and its seat. A village forming one municipality together with a group of villages may separate and become an independent municipality if a majority of its voters request this and its registered population exceeds three hundred persons and its annual financial revenues exceed ten thousand pounds. Separation shall be effected by decree upon the proposal of the Minister of Interior.

5. Text of Article 5 before its repeal: A municipality shall be established by a decision of the Minister of Interior. The establishment decision shall specify the name, seat and territorial jurisdiction of the municipality.

ARTICLE 6

Delimitation of the Municipal Territory

The delimitation of the municipal territory is an administrative measure with no connection to land registry restrictions. The documents delimiting the municipal territory shall be appended to the municipality's establishment file and the topographic survey shall be exempt from fees.
